1. Acceptance of Terms
By accessing, downloading, or using the Daily Groc mobile application ("App"), website at dailygroc.com ("Website"), or any related services (collectively, "Services"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Daily Groc, Barpeta, Assam, India.
If you do not agree to all of these Terms, you must immediately discontinue use of our Services. Your continued use constitutes acceptance of these Terms and any future modifications.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age, or use the Services under the supervision of a parent or legal guardian who agrees to these Terms.
- Be a resident of India with a valid delivery address within our serviceable area.
- Have a valid phone number and email address for account verification.
- Not have been previously banned or suspended from our platform.
By using our Services, you represent and warrant that you meet all eligibility requirements.
3. User Accounts
To place orders, you must create an account by providing accurate, complete, and current information. You agree to:
- Provide truthful registration information and keep it updated.
- Maintain the confidentiality of your account credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
- Not create multiple accounts for fraudulent or abusive purposes.
We reserve the right to suspend or terminate accounts that violate these Terms or are deemed inactive for more than 12 consecutive months.
Account Deletion: You may request permanent deletion of your account and all associated personal data at any time. Refer to our Privacy Policy — Section 9 or our Account Deletion page for instructions.
4. Our Services
Daily Groc is an online grocery delivery platform that enables users to:
- Browse and purchase grocery products, fresh produce, household items, and other daily essentials.
- Place orders for home delivery within our serviceable pincode areas.
- Choose delivery time slots including instant and scheduled delivery.
- Track orders in real-time from placement to delivery.
- Earn and redeem loyalty points and referral rewards.
We strive to ensure the accuracy of product listings, images, and descriptions. However, actual product appearance and packaging may vary slightly.
5. Orders & Payments
5.1 Placing Orders
- Orders can be placed through the App or Website.
- By placing an order, you make an offer to purchase the selected products at the listed prices.
- An order is confirmed only when you receive an order confirmation via the App/SMS/WhatsApp.
- We reserve the right to refuse or cancel any order at our discretion, including for reasons of product unavailability, pricing errors, suspected fraud, or delivery constraints.
5.2 Payment Methods
We accept the following payment methods:
- Cash on Delivery (COD): Pay the rider upon delivery with exact change or via QR scan.
- UPI: Pay via any UPI app (Google Pay, PhonePe, Paytm, etc.).
- Online Payment: Credit/debit cards and net banking through secure payment gateways.
- Daily Groc Wallet: Use your wallet balance or loyalty points for partial or full payment.
All payments are processed through secure, PCI-compliant payment gateways. We do not store your complete card details.
5.3 Pricing
All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless otherwise stated. Delivery charges, packaging fees, and other applicable charges will be displayed at checkout before you confirm your order.
6. Pricing & Availability
- Product prices and availability are subject to change without prior notice.
- Prices displayed at the time of order placement will apply to that order.
- In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel the order for a full refund.
- Promotional prices, discounts, and coupon codes are subject to specific terms and may be modified or withdrawn at any time.
- Product images are representative. Actual products may vary in appearance, packaging, or weight.
7. Delivery Policy
- Service Area: We deliver to select pincodes within Barpeta and surrounding areas. Check your pincode's serviceability on our app.
- Delivery Time: Estimated delivery times are displayed at checkout. Instant delivery orders typically arrive within 15–30 minutes. Scheduled delivery orders are delivered within the chosen time slot.
- Delivery Hours: Our delivery service operates during the hours displayed on the app, which may vary by location and season.
- Delivery Attempts: You must ensure someone is available at the delivery address. If delivery cannot be completed due to unavailability, incorrect address, or inaccessible location, we may cancel the order and applicable charges may not be refunded.
- Delivery Fee: Delivery charges, if applicable, are clearly shown at checkout. Free delivery may be offered on orders above certain thresholds or during promotional periods.
Disclaimer: Delivery times are estimates and not guaranteed. Delays may occur due to weather, traffic, high demand, or other unforeseen circumstances. We are not liable for any losses arising from delivery delays.
8. Cancellation Policy
8.1 Cancellation by User
- You may cancel your order before it is packed for a full refund.
- Once the order is packed or out for delivery, cancellation may not be possible.
- Repeated cancellations may affect your account standing.
8.2 Cancellation by Daily Groc
We reserve the right to cancel any order for the following reasons:
- Product is out of stock or unavailable.
- Delivery address is outside our serviceable area.
- Suspected fraudulent or abusive activity.
- Pricing or technical errors on our platform.
- Force majeure events (natural disasters, government restrictions, etc.).
In case of cancellation by us, you will receive a full refund to your original payment method.
9. Returns & Refunds
9.1 Return Eligibility
- Products can be returned if they are damaged, defective, expired, or different from what was ordered.
- Returns must be initiated within 24 hours of delivery by contacting our support team.
- Perishable items (fresh produce, dairy) must be reported at the time of delivery or within 2 hours.
- Items opened, used, or altered after delivery may not be eligible for return.
9.2 Refund Processing
- Prepaid Orders: Refunds are credited back to the original payment method within 5–7 business days.
- COD Orders: Refunds are credited to your Daily Groc Wallet for future use.
- Wallet Payments: Refunds are instantly credited back to your wallet balance.
We reserve the right to inspect returned items before processing a refund. Our decision on refund eligibility is final.
10. Wallet & Rewards Program
- Daily Groc Points: You earn loyalty points on eligible purchases. Points can be redeemed as discounts on future orders.
- Referral Rewards: Earn rewards when a friend you referred places their first order. Reward amounts and conditions are subject to change.
- Wallet Balance: Refunds and promotional credits are stored in your Daily Groc Wallet. Wallet balance cannot be withdrawn as cash.
- Expiry: Points and promotional credits may have expiry dates. Unused credits will expire as per the terms stated at the time of issuance.
- We reserve the right to modify, suspend, or terminate the rewards program at any time without prior notice.
11. User Conduct
You agree not to:
- Use the Services for any unlawful or fraudulent purpose.
- Provide false, misleading, or inaccurate information.
- Abuse promotional offers, coupons, or referral programs.
- Harass, threaten, or abuse our employees, delivery riders, or support staff.
- Attempt to gain unauthorized access to our systems, accounts, or data.
- Use automated tools, bots, or scrapers to access our platform.
- Resell products purchased from Daily Groc for commercial purposes without authorization.
- Post defamatory, offensive, or harmful content on any platform referencing Daily Groc.
Violation of these conduct rules may result in immediate account suspension or termination.
12. Intellectual Property
All content on the Daily Groc platform, including but not limited to the name "Daily Groc," logo, trademarks, text, graphics, images, software, and design elements, are the intellectual property of Daily Groc and are protected under Indian intellectual property laws.
You may not copy, reproduce, distribute, modify, display, or create derivative works from any content without our prior written consent.
13. Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Services will be uninterrupted, error-free, or virus-free.
- Warranties regarding the accuracy, reliability, or completeness of product information.
14. Limitation of Liability
To the maximum extent permitted under Indian law, Daily Groc and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, data, goodwill, or other intangible losses.
- Damages arising from unauthorized access to your account or data.
- Damages arising from third-party services integrated with our platform.
Our total liability for any claim arising out of or related to the Services shall not exceed the total amount paid by you to Daily Groc in the 3 months preceding the claim.
15. Indemnification
You agree to indemnify, defend, and hold harmless Daily Groc and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to:
- Your use or misuse of the Services.
- Your violation of these Terms.
- Your violation of any applicable law or the rights of any third party.
16. Termination
We reserve the right to suspend or terminate your account and access to our Services, without prior notice, for any reason including:
- Violation of these Terms or any applicable law.
- Fraudulent, abusive, or suspicious activity.
- Extended inactivity (12+ months).
- Discontinuation of our Services in your area.
You may terminate your account at any time by requesting account deletion through the app or contacting us at privacy@dailygroc.com.
Upon termination, your right to use the Services ceases immediately. Any outstanding orders will be fulfilled or refunded, and any remaining wallet balance (excluding promotional credits) may be refunded upon request.
17. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved as follows:
- Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at support@dailygroc.com.
- Mediation: If informal resolution fails, the parties agree to attempt mediation before proceeding to legal action.
- Jurisdiction: Any legal proceedings shall be brought exclusively in the courts of Barpeta, Assam, India.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For material changes, we will notify you via in-app notification or email at least 7 days before the changes take effect.
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms.
